OFFICIAL CONTEST RULES 

 

1. SPONSOR:  

The Sponsor of the 2023 GR Corolla Chance To Buy (the “Contest”) is Destination Toyota Burnaby (“Sponsor”) located at 4451 Still Creek Drive, Burnaby, BC V5C 6G9, Canada.

2. CONTEST PERIOD: 

Sponsor “2023 GR Corolla Chance To Buy” Contest begins on December 12, 2022, at 2:00 p.m. Pacific Time (“PT”) and ends on December 26, 2022, at 11:59 p.m. PT (the “Contest Period”). 

3. ELIGIBILITY: 

The Contest is open to all legal residents of British Columbia who have reached nineteen (19) years of age at the time of entry and otherwise comply with these Official Contest Rules (the “Contest Rules”). This includes and is not limited to being in good standing with Toyota Canada, having a valid British Columbia driver’s licence and being a resident of British Columbia.

4. PRIZE: 

There is one (1) prize available to be won. The prize for this Contest is the opportunity to purchase a 2023 GR Corolla Core in Supersonic Red (the “Prize”).  THE 2023 GR COROLLA CORE IN SUPERSONIC RED, STOCK #P10129 (THE “VEHICLE”) IS NOT INCLUDED IN THE PRIZE. If the Prize opportunity to purchase the Vehicle is exercised, the confirmed Winner will be fully responsible for all costs associated with purchasing the Vehicle. The Vehicle can only be purchased through a Toyota Canada lease or finance contract. No cash purchases are allowed. The Prize is not for resale, not transferable or refundable and must be accepted as awarded with no substitutions in cash or otherwise. The Prize is subject to any terms, conditions, and restrictions imposed by their issuer or manufacturer. Any and all-prize-related and vehicle-related expenses, including without limitation any and all federal, provincial, and/or local taxes, fees, surcharges, and costs incurred in picking up the Prize, shall be the sole responsibility of the Winner. The prize and contract must be finalized and claimed by January 3, 2023. Failure to comply with the Contest Rules will result in forfeiture of the prize. Acceptance of the prize constitutes permission for Sponsor to use Winner’s name, likeness, and entry in perpetuity for purposes of advertising and trade without further compensation, unless prohibited by law. Destination Auto Group (“DAG”), Sponsor and affiliates are not responsible for any of the vehicle payments, deposits, insurance, financial products, or other monetary equivalents. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. 

5. HOW TO ENTER: 

To enter for a chance to purchase the Prize, (1) ensure eligibility by filling in the Google Form (the “Eligibility Form”) during the Contest Period; (2) proceed to the Stripe (online payment processor) link to donate $100 per entry. Limit 10 entries per household. Anyone who carries out all of the above and complies with the Contest Rules will be entered for a chance to purchase the Prize. All Contest entries must be received by the end of the Contest Period. All entries become the property of Sponsor and will be stored and destroyed in compliance with the Freedom of Information and Protection of Privacy Act. Sponsor is not responsible for and accepts no liability for late, lost, misdirected, delayed, invalid, or incomplete entries. Any person who enters more than the allowable number of entries into the Contest using multiple user names or identities will be disqualified by Sponsor , in its sole discretion. No tax receipts are available. Payments will not be refunded. All proceeds will go to the Burnaby Hospital (the “Charity”). Tax receipts will not be issued. For mail-in entries, after completing the Eligibility Form during the Contest Period, on a postcard (no smaller than 3 ½ x 5 inches and no larger than 4 ¼ x 6 inches), handwrite your complete name, mailing address, phone number and age and mail with proper and sufficient postage to Destination Toyota Burnaby, 4451 Still Creek Drive, Burnaby, British Columbia, V5C 6G9. All mail-in entries must be original (no photocopies or other reproductions) and must be received during the Contest Period. All postcards must be mailed individually. All entries become the sole and exclusive property of the Sponsor and entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, mutilated, incomplete, invalid, unintelligible, misdirected, postage-due, technically corrupted or garbled entries or mail which will be disqualified or for problems of any kind whether mechanical, human or electronic which may interfere with one’s ability to participate in the Contest.  Mail-in entries not received by the final draw date will not be eligible for any draw. Proof of submission will not be deemed to be proof of receipt by Sponsor. The Sponsor’s clock is determinative of time.

 

6. WINNER SELECTION:

A random draw will be conducted on December 28, 2022, between 12:00 p.m. PT and 1:00 p.m. PT by Sponsor in-store at Destination Toyota Burnaby (4451 Still Creek Drive, Burnaby, BC) to select one (1) Winner and two (2) Runner-Ups. Valid entrants are welcome to attend. The chances of winning depend on the total number of eligible entries received. The Winner will receive the opportunity to purchase a 2023 GR Corolla with Runner-Ups being selected only for the purpose of acting as a contingency in the event that the Prize Winner is unable to make the purchase. The Winner will be announced, by stating the last 3 digits of their postal codes and the last 4 digits of their credit cards. The first Runner-Up and Second Runner-Up will not be announced. Ties or splits will not be possible. If the draw Winner is unable to meet Toyota Canada’s financing or leasing requirements, the First Runner-Up will be named the new Winner. If the First-Runner Up is unable to meet the Toyota Canada’s financing or leasing requirements, the Second Runner-Up will be named the new Winner. If the Second Runner-Up is unable to meet the Toyota Canda financing or leasing requirements, a new draw will be run on a new draw day, using the aforementioned format. The name and credit card information of the Winner and Runner-Ups will be validated in person. 

 

The Winner will be contacted by phone if the Winner is not at Destination Toyota Burnaby during the draw. 

The Sponsor will contact the selected entrant who will be required to, (a) correctly answer a mathematical skill-testing question and (b) sign and return a Declaration, Consent and Release Form in order to receive the Prize. At least two (2) attempts will be made over the two (2) days following the draw to contact the Winner. If the Winner cannot be contacted, fails to answer the skill-testing question correctly, fails to complete and return the Declaration, Consent and Release form within two (2) business days after being contacted, or cannot accept the prize for any reason, then at Sponsor’s sole discretion, that Winner will be disqualified and the Runner-Ups will be contacted. By accepting the prize, the Winner consents to the use of their names, photograph or other likenesses for any publicity purpose connected with this Contest without further compensation, within or outside of Canada. 

To claim the Prize, Winner must provide the following documents on request:

  • Signed and witnessed Waiver Form
  • A copy of their valid Photo Identification
  • A copy of their credit card for verification 
  • A copy of their valid ID associated to the credit card billing address
  • Proof of their entry fee / donation

7. CUTOFF TIMES AND DATES:

Contest entry ends on December 26, 2022, at 11:59 p.m. PT. The draw is on December 28, 2022, between 12:00 p.m. PT and 1:00 p.m. PT. The Prize and contract must be finalized and claimed by January 3, 2023, at 8:00 p.m. PT.

 

8. ENTRIES: 

All entry fees will be donated to the Burnaby Hospital (the “Charity”). All Contest entries must be received by the end of the Contest Period. All entries become the property of Sponsor and will be stored and destroyed in compliance with the Freedom of Information and Protection of Privacy Act. Sponsor is not responsible for and accepts no liability for late, lost, misdirected, delayed, invalid, or incomplete entries. Limit 10 entries per household. 9. PUBLICITY: 

The Winner and Runner-Ups consent to the release of their names, the last 4 digits of their credit card, and the last 3 digits of their postal code by the Sponsor.

10. LIMITATIONS:

In the event of any loss to or destruction of any entries or fees whether through inadvertent negligence or any cause whatsoever, the liability of the Sponsor shall be limited to the cost of the entry fees provided that no compensation will be made in absence of proof of purchase to the satisfaction of the Sponsor. In the event that the draw is delayed or cannot occur, a substitute draw will be held. Notification to entrants will be via email. The substitute draw will be held on the next available calendar date.

 

11. RELEASE: 

As a condition of and in consideration for receiving the Prize the Winner will be required to execute a release, waiver and indemnity in favour of DAG, Sponsor and affiliates, its officers, directors, employees and agents, releas­ing the aforesaid from any and all liability, damages, costs and expenses which may be suffered or incurred by the winner arising from or in any way connected to the Prize and indemnifying the aforesaid in respect of any such claim of any third party.

 

12. CONSENT:

By entering the Contest, all entrants agree and consent and give a royalty-free, irrevocable right and license to Sponsor and DAG to use their name and likeness, in any advertising, promotion and marketing by Sponsor and DAG, in any medium or form of distribution (electronic or otherwise), whether inside or outside Canada, without compensation, for the purpose of the Contest. Entrants further agree that their entry, including their personal information, name, and additional information in the forms, may be stored and processed on servers located both inside and outside of Canada, for the purpose of this Contest. Once submitted, entries cannot be modified, deleted or cancelled by a Contest entrant. All entrants acknowledge and agree that their information is being provided to Sponsor, Google and Stripe and other entities used in processing this data or for advertising. Any questions or complaints regarding the Contest should be directed to Sponsor and not to the respective platform. 

 

13. PRIVACY:

Sponsor and DAG will use any personal information provided with the entry, including, but not limited to, the entrants’ name, address, postal code, email, and phone number for the purpose of administering the Contest, as contemplated by these Contest Rules. 14. GENERAL CONDITIONS:

By entering the Contest, entrants accept and agree to be bound by these Contest Rules and the decisions of Sponsor, which shall be final and legally binding. No correspondence will be entered into by Sponsor with respect to the Contest except with selected entrants. Sponsor reserves the right to terminate or amend this Contest at any time without prior notice. The Contest is subject to the laws of the Province of British Columbia and all applicable federal and municipal laws. The sole jurisdiction to resolve any disputes concerning this Contest is the Province of British Columbia 

 

15. DISQUALIFICATION:

Sponsor reserves the immediate right to disqualify any entrant who is deemed, in its sole discretion, (i) is not in compliance with these Contest Rules, (ii) tampers with the entry process, the Contest, or the website; or (iii) is acting in an uncooperative, unsportsmanlike, disruptive, abusive, or threatening manner. 

 

16. LIMITATION OF LIABILITY:

By entering this Contest, all entrants agree to release, discharge and hold harmless Sponsor and their respective partners, affiliates, advertising/promotional agencies, and their employees, officers, directors, representatives and assigns from any claims, losses and damages arising out of their participation in this Contest and the acceptance, possession, use, or misuse of the Prize awarded hereunder. Sponsor, nor any of their employees, officers, directors, agents, contractors, representatives, affiliates, subsidiaries, independent judges or advertising/promotion agencies (collectively, the “Released Parties”) assume no responsibility whatsoever for delayed, failed, partial or garbled computer or fax transmissions, mail or postage delay or mishaps; technical failures of any kind, including, but not limited to lost, interrupted or unavailable network server, Internet Service Provider (ISP), website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, fax or cable transmissions, lines or technical failures or difficulties; the incorrect or inaccurate capture or failure to capture information whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in this Contest or other information; the failure to capture any such information; errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to this Contest; theft, loss, destruction or damage to entries, in whole or in part; or other factors beyond their reasonable control. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials to or from or use of the web site. Persons who tamper with or abuse any aspect of this Contest or website, as solely determined by Sponsor will be disqualified. 

 

17. DISPUTE:

This Contest is governed by the laws of British Columbia without respect to conflict of law doctrines. As a condition of participating in the Contest, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in British Columbia having jurisdiction. Further, in any such dispute, under no circumstances shall the entrant be permitted to obtain Prize for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the entrant’s actual out-of-pocket expense (i.e. costs associated with entering this Contest). Entrant further waives all rights to have damages multiplied or increased. 

 

18. AGREEMENT TO CONTEST RESULTS:

By participating, the Entrant (“You”) agrees to be fully unconditionally bound by the Contest Rules, and You represent and warrant that You meet all the eligibility requirements. In addition, You agree to accept the decisions of Sponsor as final and binding as it relates to all the content of this Contest.
